From Google's web site:
You still can't access Bard with a Google Account managed with a Google Workspace for Education account designated as under the age of 18.
So yes, your teacher can use Bard, but students under the age of 18 are not permitted to use Bard, even with parental consent at this point in time.
As for your second question, there are a number of companies that are trying to fill this space for students, but many will run into the same age restrictions. I am hearing some interesting information about Flint, but have not researched them at this point in time.
We have take a different route, which is to set up an OpenAI API account and have set up private instances using TypingMind (https://custom.typingmind.com/use-case/chatgpt-for-educators). We have given access to our administrators and teachers who are interested, and are currently using in an 8th grade trimester course and an Upper School interim term (9th-11th graders).

I wondered if your schools use Google Bard with their students and if we need parental consent. We already use Google Workspace for Education and have listed the different apps to inform and get consent from parents in our school handbook 23-24. However, Bard is not listed yet. I read that we must collect parent-guardian consent for students aged 13 to 17. Am I correct with this information? Is Bard for teens available within Google Workspace for Education? We think we will add this information to the handbooks for the new academic year 24 -25 because if we send one isolated communication now about consent, we may have a few parents who won't allow.
Teachers are already using Bard.
